2em;'>仙桃法院经审理认为，《中华人民共和国民法典》第一千二百五十七条规定，<strong>因树木折断、倾倒或者果实坠落等造成他人损害，林木的所有人或者管理人不能证明自己没有过错的，应当承担侵权责任。</strong>本案中，A公司作为树木的所有人，其所有的树木折断、掉落，造成刘某的车辆受损，A公司应当承担赔偿责任。树木被大雪压断，虽属于自然原因，但气象部门已提前发布了雨雪天气预报，A公司<strong>对恶劣天气应当预见</strong>，并应采取合理措施避免树木被雨雪压断，本案不属于不可抗力。A公司虽已修剪了部分树枝，但未及时除雪，亦未设置相关警示标志，导致树木被积雪压断损坏刘某车辆，未充分尽到管理职责，应当承担主要侵权责任；刘某明知有冻雨及大雪极端天气，仍将车辆停放树下，未尽到注意义务，需要承担部分责任。</section><section
