1.75em;'>仙桃法院经审理认为，案涉借款协议约定的借款期限至2025年10月，同时约定了按年支付利息，王某已依约向张某提供了借款，至2023年10月，张某应支付的借款利息为19.5万元，但张某仅支付了10万元利息，且在王某多次催讨后至今仍未支付，即在借款到期前，<strong>张某以自己的行为表明不履行合同义务，此时王某可以解除与张某之间的借款合同，并要求张某提前偿还借款</strong>。</p><p 2.21428em;'>在民间借贷中，双方当事人对借款偿还期限有约定的，应当按照约定履行，但并不是只有在借款到期后，出借人才可以要求借款人偿还借款。如果出借人有证据证明借款人已经明确表示不履行还款义务，主观上存在违约的故意，或者以自己的行为表示不履行还款义务，且将来也不可能继续履行还款义务的，出借人可以此为由向法院主张借款人提前偿还借款。本案中，借贷双方约定了借款利率为年利率10%，按年支付，并未违反法律规定，<span style='color: rgb(15, 148, 241);'><strong>张某未按约定支付利息，且在王某多次催讨后仍不支付，应视为以自己的行为表明不履行合同义务，即存在预期违约</strong></span>。王某作为出借人，可以提前终止与张某的借款合同，要求张某提前偿还借款本金及支付相应利息。</p></section></section></section><section
