letter-spacing: 1.5px; color: rgb(51, 51, 51);"><p><br></p><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> 为鼓励公众积极参与生态环境监督管理，严厉打击生态环境违法行为，根据《中华人民共和国环境保护法》《湖北省生态环境违法行为举报奖励办法》，2022年，市生态环境局出台了《仙桃市生态环境违法行为举报奖励办法（试行）》。两年试行期内，效果明显。近日，我局正式出台《仙桃市生态环境违法行为举报奖励办法》。该办法共包含总则、举报奖励的条件和范围、奖励标准、奖励实施、监督管理、附则等6章26条，自印发之日起施行，有效期为五年。主要包括以下内容：</span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> <strong>一、举报奖励的条件和范围</strong></span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> （一）举报途径。举报人可以用电话、网络、来信来访等方式，通过以下途径提交举报信息:</span><span style="letter-spacing: 2px;font-size: 17px;color: rgb(255, 41, 65);"><strong>电话举报12345</strong></span><span style="letter-spacing: 2px;font-size: 17px;">；来信地址为我局应急信访科；</span><strong><span style="letter-spacing: 2px;font-size: 17px;color: rgb(255, 41, 65);">来访地址为我局102办公室</span></strong><span style="letter-spacing: 2px;font-size: 17px;">；以及通过上级部门交办或其他部门转送、移送等其他途径。</span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> （二）举报事项分类。按照违法行为的危害性和后果的严重性，将举报事项分为重大举报事项、较大举报事项和一般举报事项。</span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> </span><span style="letter-spacing: 2px;font-size: 17px;background-color: rgb(255, 41, 65);color: rgb(255, 255, 255);"><strong>重大举报事项主要包括6种</strong></span><span style="letter-spacing: 2px;font-size: 17px;">，分别是：</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">①</span><span style="letter-spacing: 2px;font-size: 17px;">在饮用水水源地一级保护区、自然保护区核心区以及国家确定的重要江河、湖泊水域排放、倾倒、处置有放射性的废物、含传染病病原体的废物、有毒物质的;</span><span style="letter-spacing: 2px; font-size: 17px; text-decoration-line: underline; color: rgb(255, 41, 65);">②</span><span style="letter-spacing: 2px;font-size: 17px;">非法排放、倾倒、处置危险废物三吨以上的;</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">③</span><span style="letter-spacing: 2px;font-size: 17px;">排放、倾倒、处置含铅、汞、镉、铬、砷、铊、锑的污染物，超过国家或者地方污染物排放标准三倍以上的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">④</span><span style="letter-spacing: 2px;font-size: 17px;">排放、倾倒、处置含镍、铜、锌、银、钒、锰、钴的污染物，超过国家或者地方污染物排放标准十倍以上的;</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">⑤</span><span style="letter-spacing: 2px;font-size: 17px;">通过暗管、渗井、渗坑、灌注或者篡改、伪造监测数据，或者不正常运行治污设施等逃避监管的方式违法排放污染物的；</span><span style="letter-spacing: 2px; font-size: 17px; text-decoration-line: underline; color: rgb(255, 41, 65);">⑥</span><span style="letter-spacing: 2px;font-size: 17px;">其他构成污染环境犯罪或因单个违法行为被处以一百万元以上罚款、责令停产整顿、责令停业、关闭等行政处罚的情形。</span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> </span><span style="letter-spacing: 2px;font-size: 17px;background-color: rgb(255, 41, 65);color: rgb(255, 255, 255);"><strong>较大举报事项主要包括7种</strong></span><span style="letter-spacing: 2px;font-size: 17px;">，分别是：</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">①</span><span style="letter-spacing: 2px;font-size: 17px;">依法应当申请排污许可证但未取得排污许可证排放污染物的;</span><span style="letter-spacing: 2px; font-size: 17px; text-decoration-line: underline; color: rgb(255, 41, 65);">②</span><span style="letter-spacing: 2px;font-size: 17px;">非法排放、倾倒、处置危险废物或无危险废物经营许可证从事收集、贮存、利用、处置危险废物经营活动，造成环境污染但尚未构成犯罪的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">③</span><span style="letter-spacing: 2px;font-size: 17px;">在自然保护地内进行非法开矿、修路、筑坝等行为造成生态破坏的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">④</span><span style="letter-spacing: 2px;font-size: 17px;">非法排放、倾倒、处置有放射性的废物、含传染病病原体的废物、有毒物质等污染物，尚未构成犯罪的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">⑤</span><span style="letter-spacing: 2px;font-size: 17px;">超过排放标准或者超过重点污染物排放总量控制指标排放污染物，被处以五十万以上罚款行政处罚的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">⑥</span><span style="letter-spacing: 2px;font-size: 17px;">在饮用水水源保护区设置排污口的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">⑦</span><span style="letter-spacing: 2px;font-size: 17px;">公安部门根据生态环境保护相关法律法规对被举报人实施行政拘留或因单个违法行为被处以五十万以上罚款行政处罚的。</span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> </span><strong><span style="letter-spacing: 2px;font-size: 17px;background-color: rgb(255, 41, 65);color: rgb(255, 255, 255);">一般举报事项主要包括5种</span></strong><span style="letter-spacing: 2px;font-size: 17px;">，分别是：</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">①</span><span style="letter-spacing: 2px;font-size: 17px;">建设项目未批先建或未验先投等违反建设项目环境保护管理规定的;</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">②</span><span style="letter-spacing: 2px;font-size: 17px;">产生含挥发性有机物废气的生产和服务活动，未达到挥发性有机物无组织排放控制标准的;</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">③</span><span style="letter-spacing: 2px;font-size: 17px;">擅自倾倒、堆放、丢弃、遗撒工业固体废物的，或者未采取相应防范措施，造成工业固体废物扬散、流失、渗漏或者造成其他环境污染的;</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">④</span><span style="letter-spacing: 2px;font-size: 17px;">从事畜禽规模养殖未及时收集、贮存、利用或者处置养殖过程中产生的畜禽粪污等固体废物的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">⑤</span><span style="letter-spacing: 2px;font-size: 17px;">其他经生态环境主管部门立案查处的生态环境违法行为。</span></section><section style="line-height: 1.75em;"><span style="letter-spacing: 2px;font-size: 17px;"> </span><span style="letter-spacing: 2px;font-size: 17px;color: rgb(255, 255, 255);background-color: rgb(255, 41, 65);"><strong>6种情形不予奖励</strong></span><span style="letter-spacing: 2px;font-size: 17px;">，分别是：</span><span style="letter-spacing: 2px; color: rgb(255, 41, 65); text-decoration-line: underline;">③</span><span style="letter-spacing: 2px;font-size: 17px;">举报的生态环境违法行为尚在整改期限内或已被立案查处的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">④</span><span style="letter-spacing: 2px;font-size: 17px;">举报事项系已在新闻媒体曝光或已进行申诉、诉讼的；</span><span style="letter-spacing: 2px; font-size: 17px; color: rgb(255, 41, 65); text-decoration-line: underline;">⑤</span><span style="letter-spacing: 2px;font-size: 17px;">举报人系从相关国家工作人员或其近亲属处获取违法行为线索的；</span><span style="letter-spacing: 2px; font-size: 17px;
