17px;'>适用拒不支付劳动报酬罪最为主要的目的在于促使行为人积极履行支付劳动报酬的义务，以充分维护劳动者的合法权益。因此，《最高人民法院关于审理拒不支付劳动报酬刑事案件适用法律若干问题的解释》第六条规定：“拒不支付劳动者的劳动报酬，尚未造成严重后果的，在刑事立案前支付劳动者的劳动报酬，并依法承担相应赔偿责任的，可以认定为情节显著轻微危害不大，不认为是犯罪；在提起公诉前支付劳动者的劳动报酬，并依法承担相应赔偿责任的，可以减轻或者免除刑事处罚；在一审宣判前支付劳动者的劳动报酬，并依法承担相应赔偿责任的，可以从轻处罚”。该条规定坚持贯彻宽严相济刑事政策，最大限度地发挥刑法的威慑和教育功能。本案中，邓某某在一审宣判前清偿了所拖欠的全部员工工资，具有悔罪表现，有效降低了社会危害性，法院依法对其从轻处罚，适用非监禁刑。</span></p><p
