2em;">主要包括：不履行、不正确履行准入退出职责，拖延不办、私设门槛、刁难企业、吃拿卡要、收受或索取财物；涉企窗口服务不优，服务承诺落实不到位，该取消的许可事项、证明事项不取消，该减的许可条件、许可程序不减，该推行告知承诺制的不推行的问题等。</span></p></section></section></section><section style="line-height:2em;font-size:16px;text-indent:2em;"><strong>2．不具备主体资格的组织实施行政检查的问题。</strong><span style="line-height: 2em;">主要包括：不具备执法主体资格的议事协调机构、委托检验检测机构、科研院所、中介机构等组织具体实施行政检查的问题；未取得执法证件的执法辅助人员、社区工作人员、临时工等人员实施行政检查的问题等。</span></p><p style="line-height:2em;font-size:16px;text-indent:2em;"><strong>3．检查频次过多，同一事项重复检查、多头检查的问题。</strong>主要包括：行政检查事项未对照权责清单实施、未依据权责清单调整情况及时调整行政检查事项的问题；实施未经公布的行政检查事项的问题等。</p><p style="line-height:2em;font-size:16px;text-indent:2em;"><strong>4．逐利检查、任性检查的问题</strong>。主要包括：将入企检查行为作为行政许可、行政给付等行政行为前提的问题；违反“五个严禁”“八个不得”的问题等。</p><p style="line-height:2em;font-size:16px;text-indent:2em;"><strong>5．检查标准、程序不明确，随意检查的问题。</strong>主要包括：不同的行政部门没有进行有效统筹协调，对同一企业频繁开展各类检查的问题；不同地区甚至同一地区不同执法人员在开展涉企行政检查时，执行标准不一致的问题；涉企检查缺乏计划性和规范性，存在随意进入企业开展检查的问题等。</p><p style="line-height:2em;font-size:16px;text-indent:2em;"><strong>6．运动式检查、“走过场”检查的问题。</strong>主要包括：专项检查不符合监管的客观需要，未经评估、未制定计划、未经批准的问题；“一人生病，大家吃药”的全覆盖、无差别检查的问题等。</p></section></section></section><section style="text-indent:2em;line-height:2em;font-size:16px;"><strong>7．对企业处罚依据适用不准确的问题。</strong><span style="line-height: 2em;">主要包括：在涉企行政处罚时出现适用依据错误，将不适用于企业特定行为的条款拿来作为处罚依据的问题等。</span></p><p style="text-indent:2em;line-height:2em;font-size:16px;"><strong>8．自由裁量权滥用的问题。</strong>主要包括：不认真执行首次轻微违法免予处罚、违法行为情节轻微或者社会危害较小可以不实施处罚的问题；未制定行政裁量权基准，随意确定处罚额度，对相似违法情形的不同企业做出差异较大的处罚决定，存在“同案不同罚”的问题等。</p><p style="text-indent:2em;line-height:2em;font-size:16px;"><strong>9．证据收集不规范、处罚程序履行不到位的问题。</strong>主要包括：未按规定保障企业的陈述、申辩权，在作出处罚决定前没有充分听取企业的意见，或者未依法告知企业有要求听证的权利，未建立投诉举报渠道，投诉举报未及时处理和反馈的问题等。</p><p style="text-indent:2em;line-height:2em;font-size:16px;"><strong>10．过度执法、粗暴执法的问题。</strong>主要包括：行使对企业影响重大的处罚决定前，未经过严格的审批程序，缺乏必要的内部审核和监督机制的问题等。</p><p style="text-indent:2em;line-height:2em;font-size:16px;"><strong>11．对企业趋利性执法、选择性执法、违规异地执法的问题。</strong>主要包括：下达或变相下达罚没款指标、以罚代管、重复罚款的问题；对不同企业区别对待的问题；执法部门违反地域管辖原则，在没有明确管辖权的情况下异地执法，随意管辖的问题等。</p></section></section></section><section 2em;">主要包括：对企业财物采取查封、扣押等强制手段的事实依据不充分、未达到法定情形的问题；在实施行政强制过程中，未按规定制作详细的查封、扣押清单，没有通知企业相关人员到场见证，在解除行政强制时也未依法及时办理相关手续的问题；对扣押的企业产品、设备等财物，没有妥善保管，出现财物损坏、丢失的问题；该依法拍卖处理的没有依规操作的问题等。</span></p></section></section></section><section
