2px;">仙桃法院经审理认为，理发店洗头区域有0.2米高的台阶，张某作为理发店的经营者应对此台阶存在潜在危险性有一定的认识能力，理应铺设垫子并作出明确警示或采取其他合理措施，避免人员摔伤事故的发生。<span style="background-color: transparent;caret-color: red;">在事发时台阶处没有铺设垫子，虽在洗发台朝进门方向靠内侧的角落内贴有 “小心台阶”的红色警示标志，</span><strong><span style="background-color: transparent;caret-color: red;">但大部分字体已被磨损不易识别，起不到警示顾客注意的作用</span></strong><span style="background-color: transparent;caret-color: red;">，因此，</span><strong><span style="background-color: transparent;caret-color: red;">该理发店未能充分履行安全告知及保障义务，经营者张某对事故的发生存在一定的过错，应对赵某的摔倒受伤承担相应责任。</span></strong></span></p><p style="line-height: 2em;text-indent: 2.23529em;"><span style="font-size: 17px;letter-spacing: 2px;">赵某因疏忽大意在下台阶时不慎摔倒受伤，导致本案损害后果发生。赵某本人未尽到合理的安全注意义务，对摔伤事故的发生存在明显过错，自身应承担主要责任。</span></p><p style="line-height: 2em;text-indent: 2.23529em;"><span style="font-size: 17px;letter-spacing: 2px;">综合本案事故发生的原因及双方的过错程度，酌定原告赵某与被告张某的责任比例为</span><strong><span style="font-size: 17px;letter-spacing: 2px;">近年来，因经营者未尽到安全保障义务，导致他人在公共场所摔倒受伤的案件时有发生。安全保障义务是法律对消费者在经营场所、公共场所活动时的一种人身安全的保护，但这种保护也不是绝对的，并不是说只要消费者在公共场所受到伤害，都可以要求经营者、管理者等进行赔偿，</span><strong><span style="font-size: 17px;letter-spacing: 2px;">只有在经营者、管理者或者组织者未尽到安全保障义务时才承担侵权责任。</span></strong></p><p style="line-height: 2em;text-indent: 2.23529em;"><span style="font-size: 17px;letter-spacing: 2px;">本案中，张某作为理发店的经营者，在未尽到安全保障义务的情况下，应当承担侵权责任。消费者赵某未注意自身安全，自身存在过错，也应当承担责任。</span></p><p style="line-height: 2em;text-indent: 2.23529em;"><span style="font-size: 17px;letter-spacing:
