2px;">在本案审理过程中，赵某辩称，实际借款人是钱某，钱某因尚欠孙某借款未还清，担心再次借款孙某不同意，遂委托赵某代为借款，赵某在接收案涉借款当天就将该笔款项转给了钱某，并且借款后钱某已向孙某偿还本金4万元，因此，赵某申请追加钱某为本案被告，由钱某承担本案还款责任。庭审中，钱某的说辞与赵某一致，孙某则表示对此毫不知情，其表示与钱某在本案之外存在借贷关系，但与本案无关，不同意追加钱某为被告。</span></p><p 2px;">仙桃法院经审理认为，合法的借贷关系受法律保护。根据孙某与赵某之间的微信聊天及转账记录，能够认定孙某与赵某之间存在借贷关系。赵某虽称钱某已向孙某返还借款本金4万元，但因孙某提交证据证明钱某与其存在其他债权债务关系，该4万元无法认定为案涉借款的还款。最终，仙桃法院依法判决赵某偿还孙某借款10万元并按约定支付利息。判决送达后，双方当事人均服判息诉。</span></p><p 2px;">根据合同相对性原则，赵某作为名义借款人应承担案涉借款的清偿责任。</span></strong><span style="font-size: 17px;letter-spacing: 2px;">赵某申请追加钱某为本案被告，钱某也自愿作为本案被告加入诉讼，钱某自愿与赵某共同还款，系其真实意思表示，应视为</span><strong><span style="font-size: 17px;letter-spacing: 2px;">债务加入</span></strong><span style="font-size: 17px;letter-spacing: 2px;">，由赵某和钱某承担连带还款责任，</span><strong><span style="font-size: 17px;letter-spacing:
