2em;'>仙桃法院经审理认为，本案争议焦点在于商家作为经营者在销售商品的过程中是否存在欺诈行为？商家销售的涉案商品标注有商品详情，这种商品详情是消费者与经营者之间达成买卖合意的重要促成因素，也是经营者对消费者的公开承诺。商家在面对市场监管人员执法时辩称系自己标注错误，但已实际损害了消费者的合法权益，现商家亦无证据证明其主观上不存在欺诈的故意。王某购买羽绒服系受涉案商品的虚假宣传所为，故商家的欺诈行为成立。</section><p style='text-indent: 2.21428em;line-height: 2em;'>王某的合法权益因商家的虚假宣传受到损害，王某依法可以向商家主张赔偿。《中华人民共和国消费者权益保护法》第五十五条规定“经营者提供商品或者服务有欺诈行为的，应当按照消费者的要求增加赔偿其受到的损失，增加赔偿的金额为消费者购买商品的价款或者接受服务的费用的三倍，增加赔偿的金额不足五百元的，为五百元。法律另有规定的，依照其规定”，本案中王某购买商品价款的三倍不足五百元，应作出五百元的赔偿数额认定。</p><p 单从索赔500元就可以看出别人是专业的，不需要请律师 160元还要买羽绒服，买家绝对不是个好东西，卖家也不是好东西
