font-family: -apple-system, BlinkMacSystemFont, "Helvetica Neue", "PingFang SC", "Hiragino Sans GB", "Microsoft YaHei UI", "Microsoft YaHei", Arial, sans-serif; letter-spacing: 0.544px; box-sizing: border-box !important;"><span style="font-size: 16px;font-family: mp-quote, -apple-system-font, BlinkMacSystemFont, Helvetica Neue, PingFang SC, Hiragino Sans GB, Microsoft YaHei UI, Microsoft YaHei, Arial, sans-serif;">9月底,记者来到位于黄金大道的福星城小区进行采访。邱先生租赁的商铺铺号为6-110,正对着黄金大道。店内安放有多台生产豆芽菜的机器设备,因无电处于停工状态。</span></p><p><br></p><p><span style="font-size: 16px;">邱先生告诉记者,福星城商铺用电目前属于“转供电”,由物业代收电费,收费标准为每度0.74元。他于今年3月上旬租下该商铺,3月17日前往小区物业——武汉银湖物业管理有限公司仙桃福星城物业客服中心(以下简称银湖物业)办理了相关手续。物业工作人员根据相关公式计算,要求其缴纳预存电费2321.7元,随后出具了收款收据,其中“系付”项明确填写为“预存电费”。</span></p><p><span style="font-size: 16px;"><br></span></p><p style="text-align: center;"><span class="wxart_image" wx-style="display:inline-block;"></span></p><p style="text-align: center;"><span style="color: rgb(136, 136, 136);">银湖物业为邱先生开具的“预存电费”收据</span></p><p><br></p><p><span style="font-size: 16px;">“按照正常人的理解,预存电费不就和我们预存话费一样,用了多少钱直接从账户里扣款不就行了吗?”邱先生表示,缴费时物业工作人员也并没有提醒他这项预存款不能抵扣电费。</span></p><p><br></p><p><span style="font-size: 16px;">5月25日下午,邱先生接到银湖物业的电话告知他欠电费需要缴费。“我当时就说我有预存电费,你们直接扣款就行。对方说要问领导后再回话,就没有下文了。我自然认为是已经扣了款。”邱先生强调,这是他唯一一次收到物业催缴电费的电话。</span></p><p><br></p><p><span style="font-size: 16px;">没想到,6月1日晚他却看到银湖物业对其贴出了《电费催缴单》,落款日期为5月31日。《电费催缴单》称邱先生商铺已逾期15天未缴纳电费,请其于第二天上午11时前缴纳拖欠电费,否则将在第二天下午15时停止供电服务。而此时商铺已断电了。</span></p><p><br></p><p><span style="font-size: 16px;"> “5月份在消毒保养设备,没有用电。5月尾我在机器里种下了豆芽种子,豆芽还没长成功电就被停了。”邱先生说,“豆芽从下种需要5-6天才能出售,刚开始下种子不需要电,机器是根据温度需要才用电。6月1日晚上去店里查看的时候就发现电已经停了,导致这批豆芽种子全部损失。”</span></p><p><br></p><p><span style="font-size: 16px;">对此,邱先生感到非常困惑:“就算预存电费不能抵扣,难道物业就有权利断我的电吗?”</span></p><p><br></p><p><span style="font-size: 16px;">此次断电后,邱先生未再进行生产。随后,他找到银湖物业要求退还剩余预存电费并赔偿相应损失。6月底,银湖物业在收取电费848.4元与物业服务费87.7元后,通过微信转账退还了邱先生预存电费1385.6元。</span></p><p><br></p><p><span style="font-size: 16px;">邱先生认为,此前自己缴纳的是预存电费,物业本可以从预存电费里扣款却仍催缴电费并断电,既造成了其经济损失又侵害了其合法权益。</span></p><p style="outline: 0px; font-family: -apple-system, BlinkMacSystemFont, "Helvetica Neue", "PingFang SC", "Hiragino Sans GB", "Microsoft YaHei UI", "Microsoft YaHei", Arial, sans-serif; letter-spacing: 0.544px; box-sizing: border-box !important;"><span style="font-size: 16px;font-family: mp-quote, -apple-system-font, BlinkMacSystemFont, Helvetica Neue, PingFang SC, Hiragino Sans GB, Microsoft YaHei UI, Microsoft YaHei, Arial, sans-serif;">即使业主欠缴电费,物业真的就有权利断电吗?由于断电造成的损失,业主能要求物业进行赔偿吗?</span></p><p><br></p><p><span style="font-size: 16px;">对此,记者咨询了本报常年法律顾问、湖北沔阳律师事务所周红兵律师。周律师表示,电费不属于物业收取押金的范畴,物业也没有权利收取电费押金。物业开具的收据上明确写明的是“预存电费”,是可以抵扣电费的。</span></p><p><br></p><p><span style="font-size: 16px;">他说,根据《电力法》第五十六条“电力管理部门依法对电力企业和用户执行电力法律、行政法规的情况进行监督检查”的规定,收电费是供电部门的事,在“转供电”中,物业只是受供电部门的委托代收电费。物业为供电部门代理收电费的行为中遇到了问题,导致不能正常行使代理行为时,需与供电部门协商,由供电部门依照《电力法》的相关规定依法处理。即便业主欠缴电费,物业服务企业是无权断电的。</span></p><p><br></p><p><span style="font-size: 16px;">此外,《湖北省物业服务和管理条例》第三十七条第二款规定:“物业服务企业不得以业主拖欠物业服务费用、不配合管理等理由,减少服务内容,降低服务质量,中断或者以限时限量等方式变相中断供水、供电、供气、供热,以及实施损害业主合法权益的其他行为。”如果物业服务企业因收不到电费擅自对业主进行拉匣停电,这显然已经超出了他们与业主在合同中约定的服务范围,侵犯了业主的权益,所以是要承担相应责任的。</span></p><p><br></p><p><span style="font-size: 16px;">周律师还表示,如果因物业服务企业擅自停水、停电的行为给业主造成损失的,则要承担相应的赔偿责任。</span></p><p style="outline: 0px; 业委会和班委会是一样的东西,俗称伪军,指望他们年都过错,好的为业主着想的凤毛鳞角,绝大部分都是为了私利,物业私下给点好处就判变了{:214:}
