从最高车速看：
电动自行车最高速度不能超过25km/h。
电动轻便摩托车最高速度不大于50km/h。
电动二轮摩托车最高速度大于50km/h。
从电机额定功率来看：
电动自行车电机额定功率不大于400w。
电动轻便摩托车电机额定功率总和不大于4kw。
电动二轮摩托车电机额定功率总和大于4kw。
从整车质量来看：
电动自行车小于或等于55kg。

是的，但是这样的执法程序复杂也不可行。
因为在湖北针对目前骑电电动车不戴安全头盔处罚的话，先得执行将该电动车重新认定为“摩托车”，将其划入“摩托车”的机动车类别后，才能按照摩托车出行不戴安全头盔的处罚条例进行处罚。
所以，对目前骑电电动车不戴安全头盔处罚是两个法律行为，显然第一步执法程序转“认定”另归类就很难（不管电动车是否上牌都如此，如果上牌了，几乎无可能转认定另归类）
所以，目前在浙江、福建等省，已经出台了当地的电动自行车管理办法的省份，直接按照他们自己的地方法规中的规定，对于电动车驾驶人和乘车人未按规定使用安全头盔的进行罚款处罚。而对于湖北这种电动自行车管理办法尚在地方立法程序中的，依法依规的话只能是对电动车驾驶人和乘车人未按规定使用安全头盔的，公安交警将对其进行批评教育。
当然，生命、安全都是自己的，作为公务员、以及参公管理的编制人员、以及其他公职人员，领取国家的俸禄，就应该承担引领社会规则积极向上的责任，骑行和乘坐电动车时，主动配搭安全头盔出行。 2021年9月30日
