visibility: visible; box-sizing: border-box !important;'><span style='color: rgb(51, 51, 51);font-family: mp-quote, -apple-system-font, BlinkMacSystemFont, Helvetica Neue, PingFang SC, Hiragino Sans GB, Microsoft YaHei UI, Microsoft YaHei, Arial, sans-serif;font-size: 16px;'>在小区住宅楼里从事商业活动已不是新鲜事,美容店、培训机构、快递驿站等商业主体进入小区,住宅变商用,有人喜有人愁。一部分市民认为,不出楼就能享受各类服务,便捷了生活。另一部分市民认为,“住改商”导致外来人员增多,或多或少影响生活。</span></p><p><span style='font-size: 16px;'>而根据《民法典》第二百七十九条规定,业主不得违反法律法规以及管理规约,将住宅改变为经营性用房。业主将住宅改变为经营性用房的,除遵守法律法规以及管理规约外,应当经有利害关系的业主一致同意。</span></p><p><span style='font-size: 16px;'>本报常年法律顾问、湖北沔阳律师事务所周红兵律师对此进一步解释道,“住改商”需要满足两个条件:一是不得违反法律法规以及管理规约;二是必须征得有利害关系的业主一致同意。根据相关司法解释,“有利害关系的业主”包含本栋建筑物内的其他业主及本栋建筑物之外同一小区内的业主两类。不同的业主类型,承担的举证责任不同。而“一致同意”是指本栋楼的所有业主都同意。两个条件必须同时具备,缺一不可。</span></p><p><span style='font-size: 16px;'>“实践中,有的‘住改商’业主已经办理工商登记并取得了营业执照,要说明的是,这种办理了登记并取得了营业执照的事实属于行政登记及许可的范围,不能用来对抗当事人‘住改商’民事行为的违法性。”也就是说,即便有营业执照,利害关系业主也有权请求排除妨害、消除危险、恢复原状或者赔偿损失。</span></p><p style='outline: 0px; 除了你说的人话 楼上都是。 幸好没考虑南囯明珠 只要人家不拆承重墙关你屁事? 福星城也有 主要是噪音,之前我们一楼改为棋牌室,打夜牌的麻将声,吵闹声确实扰民 说句实话,一楼棋牌室,周围的居民基本上不想睡好觉了。麻将馆的噪音不算大,但时不时的会听见机器转动声,麻将与桌子的敲打声,持续性的,日复一日,年复一年的~ 找市场监管局,工商局,以麻将馆无证经营为由~一楼开麻将馆,确实很扰民 都是哪些人在去买东西 yy47190 发表于 2022-12-10 08:17
